General Terms and Conditions of Use of the "my Visa" Site

1 INTRODUCTION

  • The my.visa.cz Site  (the "Site") is provided to users (the "User(s)") by Visa Europe Limited, registered in England under number 5139966, with its registered office at 1 Sheldon Square, London W2 6TT (the "Visa").

  • These general terms and conditions of use of the Site (hereinafter referred to as the "Terms") govern access to and use of the Site, including its content and functions.

  • The legal relationship between Visa and the User entered into under these Terms is for an indefinite period of time.

2 DEFINITION

Capitalized words are defined as follows:

  • "Bank" means a bank operating in the Czech Republic that issued a Visa card.

  • "Benefits" means both the benefits of the Visa card and other benefits.

  • "Additional Benefits" means all other benefits offered or provided by the Bank or its partners (hereinafter referred to as the "Bank Partners"); these benefits may vary depending on the type of Visa card and may change over time.

  • "Visa Benefits" means all Visa-related benefits that are offered or provided by Visa or Visa partners ("Visa Partners"); these benefits may vary depending on the type of Visa card and may change over time.

  • "VISA Card" means a valid Visa credit or debit card at the time of use of the Site, issued by the bank that provides access to the Site. Visa Card identification is done by Visa, which includes: Visa Gold, Visa Platinum, Visa Signature and Visa Infinite.

  • "Account" means the account that the User must create in order to access the Site.

  • "Offer" means an offer made by Users to purchase goods or services from a third party (hereinafter referred to as the "Merchant") on specified terms (including financial terms or on specified dates).

  • "Site" means the Site available at my.visa.cz

  • "Service" means the service of accessing the Site on my.visa.cz.

  • "User" means a Visa card holder who has opened an account on the Site.

3 ACCEPTANCE AND MODIFICATION OF TERMS 

3-1 Before starting to use the Site, the User confirms by creating an account that he has read, understands and agrees to the Terms and Conditions. Otherwise, the User may not use the Site.

3-2 Change of conditions: 

3-2-1 Visa may change the Terms and the Services provided under the Terms for the following reasons:

a/ Changes in legislation that result in the obligation to change the content of the Terms or the Service;

b/ Imposition on VISA of obligations by public authorities, ordinary courts, tribunals or institutions of the European Union that have a direct impact on the content of the Terms or the Service;

c/ To improve the functioning of the Site or the User Service;

d/ Introducing new, additional features on the Site or improving existing functionality of the Site;

e/ Improving the technical conditions of operation of the Site; 

f/ Implementing improvements to the security of the Site or Users, including new privacy or personal data protection solutions;

g/ To ensure that the Site is protected from misuse, security threats, intrusions, or abuse that does not comply with the Terms or applicable law;

h/ Introducing a new, additional way to use the Site;

i/ Changes in the structure of the Visa capital group;

j/ Visa card type extension;

k/ Introduction of changes that are editorial or organizational in nature;

l/ Change of contact details, names (including Visa card names), identification numbers.

m/ In the event of changes to the content of the Terms under this section, Visa will amend, remove or amend the relevant provisions of the Terms only if the change in the content of the Terms is necessary and only with respect to the reason for the change and only to the extent necessary to make the proposed change. Visa will not impose any additional obligations on the User and the User will not be charged for the costs associated with implementing the change. Changes to the content of the Terms and Conditions will be made in accordance with the relevant provisions of the NCC. 

n/ Visa will notify Users of any planned change to the content of the Terms at least fourteen (14) days prior to the change becoming effective.

o/ The User may terminate the use of the Site and delete his/her account at any time in accordance with Article 4.2.3 of these Terms, even if Visa is dissatisfied with the planned or implemented changes to the Terms

3-2-2 Other changes to the content of the Terms and Conditions:

a/ In addition to the changes made by Visa in accordance with the procedure set out in Section 3.2.1 above, further changes to the content of the Terms will be made with the prior express consent of the User in accordance with the following paragraph below.

b/ Visa may propose changes to the content of these Terms. Visa will notify Users of the scope of the proposed changes, the date they will be implemented, and will seek acceptance of the revised contents of the Terms. If the User rejects or does not accept the proposed changes before their effective date, the legal relationship established on the basis of these Terms and Conditions will be terminated and, as a result, the User will lose access to the Site.

4 TERMS OF ACCESS, REGISTRATION AND USE OF THE SITE

4-1 In order to access the Site, the User must create an account. The creation of an account and the use of the Site is voluntary and may be terminated by the User at any time. You may not use the Site if applicable law prohibits you from receiving products, services or software from Visa or financial institutions.

4-2 Account Management

4-2-1 Create an account

  • 4-2-1-1 To create an account on the Site, the User must:

    • have an internet connection;

    • have a valid VISA Card; and

    • be over 18 years of age or - in the case of persons under 18 years of age but over 13 years of age - have the consent of their legal representative.

  • 4-2-1-2 To create an account on the Site, the User must click on the "Create Account" button and follow the steps below:

    • enter your VISA Card number and the information provided in the registration form;

    • create a password;

    • accept the Terms, read Visa's privacy policy, and make any other required statements.

  • 4-2-1-3 To confirm the registration, the User must click on the activation link in the received e-mail, which was sent to the address provided when creating the Account.

  • 4-2-1-4 On subsequent visits to the Site, the User may access their Account by clicking on the "Login" button and entering the required login details.

4-2-2 Change information or preferences within your account.

By clicking on the "My Account" tab, the User can check, update or change the information in their profile (personal data or password), manage their preferences and consents.

4-2-3 Delete your account

The User may terminate the use of the Site at any time and delete his/her Account in the "My Account" tab by clicking on the "Delete Account" button.".

4-2-4 "My Profile" tab

By clicking on the "My Profile" tab, the User can add their VISA Cards. The Site may publish information related to VISA Cards, e.g. contact points in case of loss, theft or damage to VISA Cards..

4-3 Removal of Sites by Visa

Visa may elect to suspend or terminate the operation of the Site, in whole or in part, with thirty (30) days' notice, unless a shorter period is required by applicable law or by a court or authority requiring Visa to suspend or terminate the operation of the Site, in whole or in part.

5 BENEFITS AND OFFERS

5-1 Advantages

  • 5-1-1 After logging in to their account, the User has access to an area on the website where information about the benefits of the VISA Card or other benefits can be presented, including the conditions related to their acquisition, activation, redemption, financial conditions and deadlines..

  • 5-1-2 Visa is responsible for the VISA Card Benefits offered or provided by Visa (as will be apparent from the description of the VISA Card Benefits on the Site). These benefits are subject to Visa's Terms of Use and Privacy Policy. Arrangements and transactions, including agreements and payments, related to these benefits are made or entered into between the User and Visa.

  • 5-1-3 The Visa Partner is responsible for the VISA Card Benefits offered or provided by a Visa Partner (as will be apparent from the description of the Visa Card Benefits on the Site). These benefits are subject to the terms of use and privacy policies of the Visa partner responsible for them. Arrangements and transactions, including contracts and payments, relating to these benefits are made or entered into between the User and a Visa partner.

  • 5-1-4 In the case of Additional Benefits offered or provided by the Bank or a Bank Partner (as will be apparent from the description of the Additional Benefit on the Website), the Bank or the Bank Partner shall be liable. These benefits are subject to the terms of use and privacy policies of the relevant bank or banking partner responsible for them. Arrangements and transactions, including contracts and payments, relating to these benefits are made or concluded between the User and the relevant Bank or Banking Partner.

5-2 Bids

  • 5-2-1 After logging in to their account, the User has access to an area on the website where information about the offers that the User can use with their Visa card can be presented, including the conditions regarding their acquisition, activation, redemption, financial conditions or deadlines.

  • 5-2-2 The Merchant is responsible for the offers.

  • 5-2-3 Offers are subject to the terms of use and privacy policy of the Merchant responsible for them. Arrangements and transactions, including contracts and payments relating to Offerings, are made or entered into between the User and the Merchant.

5-3 Benefits and Offers together

  • 5-3-1 The User is responsible for the payments that the User is obliged to make under the arrangements or transactions, including contracts, relating to benefits or offers entered into or entered into with Visa, Visa partners, banks, banking partners or merchants, including the payment of related fees (such as shipping costs), and will also independently exercise all rights associated with such arrangements and transactions (e.g. the right of withdrawal, file a complaint, report a non-conformity with the contract).

  • 5-3-2 Benefits and Offers may contain links to other Sites or domains that are owned or operated by third parties (including banks, banking partners, Visa partners, or Merchants). A user who uses such Sites or domains will be subject to and make their own decisions in this regard.

6 PRIVACY

6-1 Visa, as the data controller of Users, processes Users' personal data for the purposes set out in these Terms under the terms set out in Visa's Privacy Policy.

6-2 Users have the right to access, rectify, erase, restrict processing, the right to data portability, the right to object to processing, and the right to withdraw the consent given to Visa to the processing of personal data at any time, without prejudice to the lawfulness of the processing prior to its withdrawal. Users may exercise these rights in accordance with Visa's Privacy Policy. Users also have the right to lodge a complaint with the relevant supervisory authority, which in the Czech Republic is the Office for Personal Data Protection (www.uoou.cz), if they believe that Visa is violating their rights.

7 WARRANTIES AND LIABILITY

7-1 Warranties and obligations of the User

  • 7-1-1 The User declares that he is aware that in order to access the Site, he must have an Internet connection provided by the selected provider, the costs of which are borne by him/herself. The User acknowledges that he is solely responsible for the device and provider he uses to access the Internet and the Site, and for all related connection costs.

  • 7-1-2 UThe User undertakes to take the necessary measures to ensure the security of their devices and their own data, software or other elements, in particular against virus infection or hacking attempts.

  • 7-1-3 You may not use the Site if applicable law prohibits you from receiving products, services or software from Visa or financial institutions.

  • 7-1-4 The User declares that the personal data provided by him is accurate, up-to-date and complete in terms of his identity, contact details and other information necessary to access the Site and undertakes to update such data regularly.

  • 7-1-5 The User undertakes to create only one Account, to keep it only for themselves and to maintain confidentiality about their login data (e-mail address and password). The User agrees to notify Visa of any breach of confidentiality or security of his/her credentials immediately upon becoming aware of it.

  • 7-1-6 The user is responsible for the actions taken on their account, as long as they do not result from situations beyond their control, such as hacker activities. The User agrees to contact Visa immediately upon receipt of information about unauthorized use of the User Account or any actual or potential breach of account security.

  • 7-1-7 Visa may immediately refuse to create an account for a User, suspend access to their account, or delete their account in the event of:

    • a) if the User is under 13 years of age or if he is over 13 years of age but under 18 years of age, he does not have the consent of his legal representative – according to clause 4.2.1.1;

    • b) breach of clause 7.1.2 or 8.3 of these Terms;

    • c) if User's use of the Site constitutes a violation of the law, a threat to the operation or security of the Site, or is intended to circumvent or violate the security measures employed by Visa, or involves falsification of data.

  • 7-1-8 Information about such refusal, suspension or deletion will be provided to the User using the contact information provided by the User to Visa.

  • 7-1-9 In the event of a breach of Section 7.1.3 of these Terms, Visa may suspend access to or delete User's account after notifying the User by email sent to the address provided by the User. Visa will give the User fourteen (14) days to respond to the objections raised before suspending access or deleting the account.

  • 7-1-10 Each User agrees to provide Visa with additional information that is necessary to verify the quality or accuracy of the information provided by the User when creating an account. In the event that such additional information is not provided, Visa has the right to refuse to create a User Account, suspend access to a User Account, or delete it after the User has previously been asked to provide the requested information or to register an objection within fourteen (14) days of the call.

7-2 VISA Warranties and Liability

  • 7-2-1 Visa will endeavour to provide access to the Site, except in cases of force majeure and subject to necessary interruptions due to maintenance, updates and maintenance of computer systems (hardware or software) necessary for the operation and security of the Site. This does not limit Visa's liability under these Terms, the Civil Code or other applicable laws in the Czech Republic.

  • 7-2-2 Except as a result of circumstances for which Visa is responsible under these Terms, the Civil Code or other applicable laws in the Czech Republic, Visa shall not be liable for:

    • a/ fraud related to the use of the User's Account due to failure to keep their login details secret;

    • b/ services or goods offered by Visa Partners, banks, banks, merchants or other third parties; complaints concerning services or goods offered by these parties should be addressed directly to them;

    • c/ arrangements or transactions, including agreements entered into or entered into by the User with a bank, banking partner, Visa partner, merchant or other third party, or any payments arising out of such arrangements or transactions;

    • d/ losses, expenses or costs incurred as a result of the activities of Visa's partners, banks, banking partners, merchants or other third parties, their offerings, products or services;

    • e/ content on the Site relating to: VISA Card benefits offered or provided by Visa partners, other benefits or offers;

    • f/ failure to comply with the obligations contained in the Terms due to force majeure.

  • 7-2-3 The Site may provide Users with access to, communication with, or use of features, products, or applications belonging to third parties ("Third Party Features"), which are subject to their own terms of use, licenses, and privacy policies. Except as a result of circumstances for which Visa is responsible under applicable law in the Czech Republic, Visa shall not be liable to Users for your use of third-party features.

8 INTELLECTUAL PROPERTY

8-1 The software, structure or content of the Site used, including but not limited to logos, trademarks, images, videos, photographs, text, graphics, software or any other elements in any format and type that appear on the Site (the "Content"), are protected by copyright, trademark, patent or other intellectual property laws and are the exclusive property of Visa; Visa partners, banks, banking partners or merchants ("Rights Holder").

8-2 Any use of the Content without the express written consent of the Rights Owner, unless permitted by applicable law, constitutes an infringement of the Rights Owner's intellectual property rights, which may also result in infringement of image rights, moral rights, or other applicable laws or regulations. The user may be held liable for this, including criminal or civil liability.

8-3 With respect to the Content, it is therefore prohibited to copy, modify, reproduce, distribute, publish, including in any media, adaptation, transmission, licensing, use as security, transmission in any other way and in any form, in whole or in part, or reverse engineering or use any other method to obtain the source codes or protocols of the Site without the express prior written consent of the Owner of the Rights,  unless permitted by applicable law.

9 HYPERLINKS

9-1 The Site may contain links to other Third Party Sites independent of Visa (including Visa partners, banks, banking partners, merchants). Responsibility for the content of these Third Party Sites, including their accuracy, completeness or reliability, as well as for the products or services offered or sold on them, lies with these third parties. In addition, the existence of a link on a third-party site does not imply endorsement by Visa of such Sites or their content.

9-2 The User remains responsible for connecting to and using these Third Party Sites.

10 GOVERNING LAW AND JURISDICTION

10-1 These Terms and Conditions are subject to Czech law.

10-2 Any disputes are subject to the jurisdiction of the Czech General Courts.

11 CLAIM
